Terms of sale
A French version of these terms of sale is available: conditions générales de vente.
Seller
Jérémy Puteaux EI, sole trader (French entrepreneur individuel, micro-entreprise), SIRET 797 993 300 00038, 100 rue des hauts puits, 16590 Brie, France. contact@soulencia.com
Purpose
Soulencia offers paid self-discovery digital content, generated from the birth information provided by the buyer: portraits each devoted to a single system (Human Design, Astrology, Numerology or Dreamspell), and a Crossed Portrait that reads these four systems and then cross-references them in a single synthesis. An order can contain several of these items of content, for the buyer themselves or for other people whose birth information they provide; it is paid in a single payment. The price and exact content of each offer are shown on the site before the purchase is confirmed, and are authoritative.
Minimum age
Orders are reserved for people aged 18 or over. By ticking the box accepting these terms of sale, the buyer declares that they are 18 or over.
Country of residence
The offers are reserved for people who live in the European Union, Switzerland, Liechtenstein, Canada, the United States, Argentina, Ecuador or the Dominican Republic. Also included: Guadeloupe, Martinique, French Guiana, Réunion, Mayotte and Saint-Barthélemy.
Not included: Puerto Rico and the other territories of the United States outside the 50 states and the District of Columbia; Saint-Martin and Saint-Pierre and Miquelon; the Canary Islands, Ceuta and Melilla; the Åland Islands; and the other overseas territories of European Union countries not named above (for example New Caledonia, French Polynesia or Greenland).
This scope is not arbitrary: selling to persons residing in other countries would create, in several of them, tax obligations from the first sale.
The buyer states their country of residence in the order form, as well as their state if they reside in the United States, and guarantees that this information is accurate.
Payment by a card issued in a European Union country, Switzerland, Liechtenstein, Canada, the United States, Argentina, Ecuador or the Dominican Republic.
If the card was issued in a country that is not on this list, or if that country cannot be verified, the payment is cancelled before any charge: no amount is charged and no content is delivered. The buyer is informed by email and can pay again with a card issued in one of these countries.
Prices and payment
Prices are shown all taxes included, in euros, US dollars, Canadian dollars or Swiss francs. Each currency has its own prices, set in advance: they are not a conversion from the euro. The currency is suggested based on the country from which the site is viewed, and the buyer can choose another one; the price and currency shown when the order is placed are the ones paid and invoiced. If the buyer's card is linked to an account in a currency other than that of the order, any conversion is made by their bank, on its own terms. Payment is made in a single instalment, by bank card, through the secure Stripe platform. The amount is first reserved on the card, then charged as soon as the country where the card was issued has been verified (see "Country of residence"). Soulencia does not store any bank details: they are processed directly by Stripe.
"TVA non applicable, art. 293 B du CGI" (VAT not applicable, Article 293 B of the French General Tax Code).
After payment, the buyer receives their invoice in the order confirmation email.
Delivery
The content purchased is digital content supplied without a tangible medium. Its preparation begins after the payment is charged. It is made available on a personal page of the site, whose link is also sent by email, within about 15 minutes. No physical medium is sent.
Right of withdrawal
In accordance with Article L221-28 13° of the French Consumer Code (Code de la consommation), the right of withdrawal cannot be exercised for digital content supplied without a tangible medium when the buyer has given prior express consent for performance to begin, has acknowledged losing their right of withdrawal, and has received confirmation of this consent on a durable medium.
In practice, before payment, the buyer ticks a box, unticked by default, by which they ask for the preparation of their content to begin as soon as they pay and acknowledge that they lose their right of withdrawal from that moment. This box is separate from the acceptance of these terms of sale. After the payment is charged, and before the preparation of the content begins, Soulencia sends the buyer a confirmation email that repeats the exact text of this consent, with its date and time.
As long as the right of withdrawal exists, in particular if the preparation of the content has not yet begun or could not begin, the buyer can exercise it online, free of charge, by means of the withdrawal function accessible from this section of the terms of sale, through the following link: Withdraw from contract here. There, the buyer gives their first name and last name, their order or invoice number and the email address at which they wish to receive the acknowledgement of receipt, then confirms with the "Confirm withdrawal" button. Soulencia immediately sends them by email an acknowledgement of receipt that repeats the content of their statement, with its date and time.
Refunds
Once the preparation of the content has begun under the conditions described above, no refund is possible, except in the event of a proven technical error preventing access to the content purchased. In that case, contact contact@soulencia.com.
If the conditions laid down in Article L221-28 13° of the French Consumer Code are not met, the right of withdrawal applies.
This clause applies without prejudice to the mandatory rights of your country of residence, or to the legal guarantee of conformity (see "Legal guarantee of conformity").
Legal guarantee of conformity
Soulencia is liable for any lack of conformity of the content purchased, under the conditions laid down in Articles L224-25-1 et seq. of the French Consumer Code. In the event of a lack of conformity, write to contact@soulencia.com: you are entitled to have the content brought into conformity or, failing that, to a price reduction or to termination of the contract, under the conditions set out below.
The box below is a translation of the official text required by French law (model annexed to Article D. 211-3 of the French Consumer Code).
The consumer has two years from the supply of the digital content or digital service to obtain the application of the legal guarantee of conformity if a lack of conformity appears. For one year from the date of supply, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.
The legal guarantee of conformity includes the obligation to supply all the updates needed to keep the digital content or digital service in conformity.
The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following their request, free of charge and without significant inconvenience to them.
The consumer may obtain a price reduction while keeping the digital content or digital service, or may terminate the contract and obtain a full refund in exchange for giving up the digital content or digital service, if:
1° The trader refuses to bring the digital content or digital service into conformity;
2° Bringing the digital content or digital service into conformity is unjustifiably delayed;
3° The digital content or digital service cannot be brought into conformity without costs being imposed on the consumer;
4° Bringing the digital content or digital service into conformity causes significant inconvenience to the consumer;
5° The lack of conformity of the digital content or digital service persists despite the trader's unsuccessful attempt to bring it into conformity.
The consumer is also entitled to a price reduction or to termination of the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to ask first for the digital content or digital service to be brought into conformity.
Where the lack of conformity is minor, the consumer is entitled to cancellation of the contract only if the contract does not provide for the payment of a price.
Any period during which the digital content or digital service is unavailable in order to be brought back into conformity suspends the remaining period of the guarantee until the digital content or digital service is supplied again in conformity.
The rights mentioned above result from the application of Articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.
A trader who obstructs in bad faith the application of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of average annual turnover (Article L. 242-18-1 of the French Consumer Code).
In addition, the consumer benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This guarantee gives the right to a price reduction if the digital content or digital service is kept, or to a full refund in exchange for giving up the digital content or digital service.
Nature of the content
The content offered falls within personal development and self-knowledge. It does not constitute medical advice, psychological advice, or financial or legal advice.
The calculations are made by our programs from the birth data, and the text of the portrait is written by an artificial intelligence from these calculations.

In the event of a dispute, you can refer the matter, free of charge, to the consumer mediator we belong to: Société de la Médiation Professionnelle (SMP), Alteritae, 5 rue Salvaing, 12000 Rodez, France. Website: https://www.mediateur-consommation-smp.fr. Online referral: https://www.mediateur-consommation-smp.fr/demander-une-mediation/. Disputes
In the event of a dispute, the buyer is invited to contact contact@soulencia.com first, to seek an amicable solution. They can also use mediation (see "Consumer mediation").
These terms of sale are governed by French law, without depriving the consumer of the protection of the mandatory provisions of the law of their country of habitual residence. For consumers residing in Switzerland, Swiss law applies. Failing an amicable solution, the consumer may bring proceedings before the courts of the place where they are domiciled, or before any other court with jurisdiction under the law.
